I am sorry but if it is that easy then why don't you do it? They probably fully test VC releases to make sure it preforms as close to the original as possible. They know people love to play their games over and over again finding new things to explore, which means Nintendo will have to lots of testing before a game is good to go. Imagine if there is an issue near the end of the game. Every time some needs to see that problem they need to play through the whole game while following certain steps. A lot of work goes into everything Nintendo does.
I can't do it because I don't own the rights to their games, lol. And I suppose you're right, but I know for certain that doing those steps wouldn't take that long for Nintendo. I guarantee SMB3 is ready to be released on eShop, but Nintendo is just holding out on releasing it already.
