I had heard that just a minute ago on the IGN (or Gamespot) DS page... So sad. I have over 100 downloads, is there no way to use it outside of my system? What about the proposed new handheld (3DS) can they make them playable or transferable in the future? If not, I'm gonna stop buying these.

NOT WORTH IT!!! Nintendo needs a HUGE wake up call. This is NOT how you treat customers who are already weary of buying something intangible (with no box or physical product) like a digital download. Thanks for ruining it for us!! Seriously, hearing this makes me never want to spend $$$ on Nintendo points ever again. Do they really not realize this is whats going to happen?

Nintendo will come up with a way to transfer the DSiWare - the company is generally good with backwards compatibility, especially with handhelds. It's just not available yet.
My suggestion is to not spend any more money on Nintendo's hand-helds until they change this policy. It's unacceptable.
Agreed! While I do like the way dsiware has been going lately, I am going to have to stop downloading content until I am guaranteed there's a way to use my games I paid for on a later device. Nintendo has a lot of PR work to do, and they need to do it quick.

I guess that's one good thing about not going with the original DSi. I had seen something online about the XL about a month or two after the DSi released so that's part of the reason I waited. The other reasons being I wanted the bigger screen and I knew that DSiWare wouldn't transfer over. Kind of makes a person rethink the value of DLC, huh?
Edit: added the word "not" in the first sentence because it completely changed what I was saying without it.

Not really. Even assuming Nintendo refuses to change their own policy to transfering DSiWare (which everyone seems to be assuming, without any basis for those assumptions whatsoever), Sony, Microsoft, Apple, Amazon Kindle... all these vendors have very sound policies in regards to transferring material across to new consoles.
Since you don't have to have any type of official account (like on PSN or Xbox Live) how exactly will Nintendo tie your games to your next system? Wouldn't that leave the door open to everyone copying their games onto other people's systems and vice-versa. It's seeming like Nintendo might have a big problem with the way they've handled downloadable content this generation and I'll be curious to see if they can fix it.

I would guess that a simple software download to the DSi/ Wii would allow you to set up one of those accounts, allowing you to transfer to the next console

There's nothing to fix Corbie, this is a business strategy (and a damn fine one, I might add).
The fact is if it's only possible to transfer DSiWare from one system to another by giving both systems to Nintendo, then you need both systems at hand. Trading in won't work, obviously.
If enough people send in their DSi's for DSiWare transfer and it becomes a major issue for Nintendo (say they get bogged down with so many requests), maybe they'll come up with some automated way of doing it.
This is a major issue and its the reason that I have not bought a DSiXL. In the DSiWare terms and conditions it says that the games are assigned to the PERSON and are not transferable (e.g. I understand this to mean I cannot sell the games to someone else). To me "person" does not imply machine, so I would expect that I can transfer my purchased games to a new compatible machine. When I "agreed" these conditions I expected that I could transfer my identity from my old to my new machine (e.g. like you can keep your Nintendo online identity and scores for Mario Kart online).
I notice that in the Q&As, one answer says that you cannot transfer games to another machine, but the Q&As do not form part of the "agreement" that I/we accepted when starting to use the DSiWare service.
In short, Nintendo are screwing their customers and their customers shouldn't let them get away with it. Start by not buying a DSiXL in protest at Nintendo's policy.
I agree this is annoying, but a lot of the complaints about it (and i'm not pointing any fingers or trying to stir anything up) seem very, erm, "whiney", for lack of a better term.
The fact that you can't transfer software in no way affects your ability to play it. Yes, of course it's nicer to have everything on a nice spiffy new console/handheld, but come on. You are given a license for the software. You are able to play it on your machine. Nothing will prevent you from doing this. Nintendo is not "screwing" their customers.
Now, from a customer-satisfaction standpoint, i certainly understand the gripes, and Ninty would be wise to alter their DRM and DLC policies to better fit the changing marketplace. But that's true for a lot of Ninty's business strategies, i think.
why doesnt Nintendo sell a cartridge that can store downloads on? that way it would be much better because you can transfer them and it doesnt take up system memory
