As I said on the news post for this. I'd rather have them put GBA games on the 3DS before worrying about DS games. I mean iff I really want to play the DS games on the 3DS the 3DS can play DS cartridges where as GBA you cant. Also you can still find DS games at place like Gamestop where as GBA you cant.

seeing as how I can buy and have bought 360 games from XBLA and can buy full PSP games from PSN, Backwards compatibility is a BS excuse.
You seem to forget one thing: Nintendo is not Sony or Microsoft
Them being a different company isnt an excuse for something other companies they compete with can do.
how is it not a valid excuse? they're working on their own e-stuff, we've already seen quite a bit of improvement in the eShop over the original Wii and DSi Shops. surely by the next generation we'll see DS games available, but i can't see it happening before — not when they're focused on getting 3DS games available for dual download/retail releasing (like the next Mario game, i think i read that was supposed to be a dual-front release). i'd rather see them focus on that than have them work on getting games I already played before and/or still own up as downloadables. save that for next gen.

Once the games are out of print the publishers/developers are no-longer making money from them. Why wouldn't they do it now the hardware is there? It's a no-brainer.
and "they should do GBA first" and "they should focus on new games" stuff is a pretty average argument against the idea. We're talking about something with little effort and as close to pure profit as you can get. The game data is on their servers, rated and the hardware has full support for them. More games available makes us gamers happy and it makes Nintendo's pockets happy which means more games for us. Why not do it?

I wouldn't mind the older titles being rereleased (Mario 64, Warioware twisted, Animal Crossing WW, ETC), but anything that is shovelware or that came after 2006 wouldn't really make sense.

Yes, Nintendo needs to do this. It would greatly increase the eShop's library in many ways. If Nintendo is even remotely serious about improving their digital download service, they would put as many DS games as they possibly could on the eShop.
Don't know how likely the concept is, but I could get into it. I could get back some of my favorite DS games (the DS Zeldas, the DS Kingdom Hearts games, and Ninja Gaiden Dragon Sword especially), and could get a bunch of games I missed (Radiant Historia, Time Hollow, the DS Pokemon games, the DS Final Fantasies, ect.).
