But a lot of the time, the publisher does own the rights to the game.

• Sony owns the rights to Resistance and Ratchet & Clank, yet Insomniac is an independent developer.
• Microsoft retained the rights to Halo after they got rid of Bungie.

Look at the copyright info of the games.
