I'm still under warranty ( I sent it in for repairs last July (to fix scratches on the screen caused by the lower screen), and they did a great job in a great amount of time, and my warranty was extended by a year), so I'll be giving them a call soon.

I don't think it was related, but occasionally, when being carried, it fails to exit sleep mode when turned on, so I have to turn it off and back on again. It did that earlier in the day, prior to this happening. I think it had something to do with the pressure of being in my jacket...
This seems like a rare occurrence. Just tell Nintendo the screen is stuck on a brightness setting above the max, and you can't change it. They will probably just 'hack' your console and set it back to normal without giving you a replacement. I think this has more to do with the programming than it does the hardware.

Okay, I now know more accurately what the problem is:
In Super Mario 64 DS, you can turn off the backlight. I thought the backlight might have gotten stuck on. I first thought of this when I saw the system restarting after closing a DSiWare game. The bottom screen could be seen to go out and come back on, but the top screen remains on the whole time. Thus, I turned off the backlight in SM64DS, and it remained faintly lit instead of turning off like the bottom screen. I noticed that the brightness setting does affect the top screen, but the brightness of (I think) the backlight prevents it from changing very much.
Oh, that reminds me of something similar that happened to me with a DS game...
In The Sims 2 for DS, there's an in-game button to turn off the backlight (back then when the only settings available were "on" and "off"). If you use that button on the DSi it turns the screens off. I haven't tried it on the 3DS, but I assume it will do something similar.

oh dude that sucks... im not positive but i belive if you take it to gamestop instead they send it to nintendo and if nintendo cant fix it gamestop will send you a new one
My 3DS is arriving at its location in Chatsworth, Ca. tomorrow! I hope they can fix it quickly. I'm pretty sure they avoid resetting your data if at all possible... Last time I sent it in, it was just to fix screen scratches. This time, they probably have to open it up or hack into it or something like that. That might cause some loss of data. Wish me luck!
