Topic: Tilting 3DS XL makes unwanted menu selections

Got a brand new 3DS XL yesterday, but having a few issues with the motion/gyro sensor. (No 3DS experience, skipped straight up from DS Lite.)

1) First of all, tilting or moving it while on Home/Camera/eShop/etc causes it to automatically preform whichever action is closest to the left on the bottom bar. IE: opening games & manuals - frustrating enough - or much worse, closing suspended games.

I couldn't find anything about this in the manual or the internet, so I'm not sure if it's meant to do this or not, but either way it's extremely frustrating, since if I shift around in the slightest, it causes problems. If it's meant to work this way, is there any means of disabling it? Failing that, any tips for dealing with it would be appreciated.

2) Also, there seems to be some sort of issue where the touchscreen does not function unless the device is tilted at certain angles, even playing DS games which shouldn't be affected by motion/gyro. I'm not sure how much of an issue this is - it seemed as if it was better today than yesterday, so it might go away entirely on its own in time - but any ideas what might cause it?

I would really appreciate any help you guys could give me on this. I've spent the last 24hrs combing the internet to figure it out and been coming up blank.

I would return the item and get a replacement or contact Nintendo and book a repair. That is not normal.
Oh, and welcome to the world of 3DS. Remember to get used to the 3D first and rest your eyes when needed.
