Either this leaker really has the game, or he's really good at faking footage.
As much as I don't want to, I have to agree it might be real. There's no way he can manage to have the exact character and stage models needed to fake it, unless there's someone who can copy exact details based off screenshots. Though the lack of a gap between the top and bottom screen could be evidence its fake, this could just be content showcase video for the ESRB by the official dev team. Only time can tell at this point.
Kind of sad this butthole had to ruin the game early for us, and screw over Sakurai and his dev team.

Not necessarily . Remember, the Gematsu leak got a lot of stuff right, but Chrom isn't in, so it obviously wasn't 100% true. The leaker could've just gotten very lucky. For now, I am convinced that Shulk and Bowser Jr. are in, but I'm gonna need to see actual footage to be convinced that Dr. Mario, Pitto and the Duck Hunt Dog are in.

Nowhere in my original post did I suggest it was confirmed, but the footage (if it isn't fake) suggests the leak is real and if it is fake who ever did it has skills.

Welp, there goes any chance this leak was fake. I'm disappointed Dr. Mario and Dark Pit are not skins, they're waste of character slots. Though Jr and Shulk seem pretty cool. Zero opinion on the duck hunt dog though.
The Ersb never receives games, so it is likely that, if this footage is real and it comes from the ersb then, it's taken from the video about the game that Nintendo sent them for them to rate.
Since it is a video from Nintendo it's probably not filmed with a camera pointed at the screen of a real 3DS, so the lack of space between the screens or visible hardware is justified.
