so I wasn't sure where to post this thread but anyway here it is in the 3DS sub-forum..
I tried to look for people with similar complaints around but couldn't find any, the problem is that I got my copy of this game from an Amazon marketplace seller for around $20 (seemed cheap at the time), but when I got it it didn't look of standard Nintendo quality although it was in a shrink wrap. the first thing that seemed fishy to me is that the case felt like it was made of cheap plastic and didn't close and open as smooth as my other game cases. second thing I noticed was that there was no Club Nintendo insert (it wasn't around in 2006?)
and the final thing which I'm posting this thread to ask about, when I play this game on my 3DS all is good until I close the system to put it into sleep mode Mario's voice keeps saying the words "bye-bye" "It's me mario" in an endless loop until I open the system again, is that normal or did I get a defective/fraudulent copy of this game?
DId the seller make the game new or as used? IF it was used that could be the reason for no Club Nintendo inset and the shrink wrap. I am not sure when Club Nintendo came out but once you use the Club Nintendo insert its no good ie if you got it with a used copy. Second where was the seller from? If its from a Southeast Asia country ie Korea or Vietnam good chances are that you did by a pirated copy.

That sounds like you may have got a pirated copy. I don't know when Club Nintendo would have started where you live, but in the US, it didn't start until 2008. Before then, games had inserts to register the games on MyNintendo, although there weren't any real initiatives to do so. These codes did work on Club NIntendo though. That thing about the sleep mode voices is what gets me though; unless your console is faulty, it sounds like you have gotten a hold of a pirated copy of the game.
@Tasuki the seller marked the game as "New" and I get all my games through U.S sellers on Amazon or the company itself
@Ecto-1 I see so CN didn't exist at the time this game was released.. I don't think the console has any faults because this is the only game that has this issue, so that leaves the pirated game option.
would it harm my console then or get it blacklisted or any other bad effects?
EDIT: so I looked again at this purchase and the seller page sold games only in the summer of 2011 and no other activity after that, also he replied to negative feedback with very bad english use.. hmm..

Yep I would say that you got a pirated copy than if that is what you got for a new copy. My suggestion is contact Amazon they may be able to refund your money at least.
Next time check the buyers feedback. I cant say how many times that saves me from making a bad purchase. Thats you first clue on if you are going to get screwed or not.

it's been a long time since I made the purchase but I didn't care about it until now, I think I'll have to live with that but I learned my lesson, buy only from amazon or the featured sellers. oh and the seller had only 1 negative and 1 neutral feedback, all others were positive because I always read the feedback before any transaction over the internet.
Yeah another thing (goes for eBay too) is if they have a high rating, but no feedback whatsoever...then something should be fishy going on there. So you gotta check both and all that.

I bought my NSMB DS from Best Buy about a year or so ago, before they started putting it in the red boxes. I just checked, and mine has the Club Nintendo leaflets.
@Eureka thankfully all my eBay experiences were good, I try not to buy from sellers with low feedback scores
even clear cases are a sign of piracy, that's too much, but I wouldn't buy a game with a clear case anyway because it won't fit in nicely with my all solid game collection cases, yes I care about the small stuff

As Nintendo makes ways to stop pirate games the pirates are always one step ahead it seems. More than likely they found away around this.
