A quick note to let you all know, the bottom screen still scratches the top screen on the new 3ds. Had the system 2 weeks and have been carrying it around in my pocket. Have arranged for it to be repaired by nintendo uk. They will decide if I have to pay to get it fixed. Best to get a screen protector on when you can. Fingers crossed they don't do a system reset on it for me.
The guy on the phone shook my confidence a bit when he told me to copy my sd card just in case. Obviously it's a concern. I just wanted to let people know cos I hadn't read that it was a problem and I thought the new design would have solved it.
If sending your 3ds to nintendo, always remember your NNID and never give them your SD card with the system. You never know when they'll just replace the unit or format it.
Anyway. The only model that won't do this is the 2DS. And due to the nature of the screens, it's probably the only model that won't suffer from it in the story of the 3DS.

The guy on the helpline told me to remove my stylus and game but to leave the micro sd card in. I'm gonna have to call them to confirm. Don't want to be losing my 32 gig card.
Don't give them your 32 gig, lol just stick your sd card that came with the console... You will lose your 32gb if you send it, i would never send them my 32gig card.
This is why I always put screen protectors on all of my devices that don't have a glass screen like iPads/android tablets, I even put protectors on them even tho it's not really needed as the glass is very good at resisting deep scratches. The screens are plastic and bound to scratch, screen protectors are 7-10$ and it will save you the headache of needing to replace the screen.
The reason your getting the scratches is because you have it in your pocket. You probably have it in a tight pocket
Iike jeans, this puts so much pressure on the device that the rubber stoppers get crushed to the point where the lower screen is scratching the top screen.
I own a 3DS, 3DS XL and my Majoras Mask New 3DS XL and none show scratches on the screen protector because I don't put them in a tight pocket, I use a Hori Carrying case for my 3DS consoles when on the go and toss it in my winter jacket pocket or just carry it in my hands.
Also if you use a Hori TPU Duraflexi case for your new 3ds XL it's impossible to get these scratches. I always use these hori tpu duraflexi cases for my 3ds XL and new 3ds xl, had to import from Japan for 20$ but well worth it, non or my 3ds consoles have a scratch on their housing or their screens.
Imo people need to take more care with their devices, this was a know flaw for every clamshell 3ds desgin you should of took steps to take care of the screen like putting a micro fiber cloth in between the screens when you close it or use the foam that came with the new 3ds untill somone confirmed if it happens or not, now we know we always need something to protect the screens. Nintendo should of found a way to prevent this but they didn't so unless you have a TPU case or a cloth between the screen/screen protector then it should not be put into a tight pocket. My origional Launch 3ds never had a case but has screen protector yet there is no sign of scratches on the screen protector.
Well I hope you learned that when you get your repaired new 3ds that you will put a screen protector and a Hori tpu duraflexi case or use a microfiber cloth and stop putting it in tight pocket, if not it will happen again.
@mrGREEK360 Good post, but also the 3DS (2DS/XL/New/New XL) bottom screen is prone to be damaged just using the stylus over it, because of the plastic used by Nintendo to cover the screens. Hopefully next Nintendo handheld is better designed.

I didn't get a screen protector on my PSVita fast enough, I now have a deep scratch on the screen that annoys me every time I play it, and it only took one day.
I hope Nintendos next handheld console has glass screens, plastic screens should be banished, Glass screens will make the device feel more premium and less of kids toy, and if they keep the clamshell design then they will be well protected from breaking during a fall.
The bottem screen should of been glass as it's constantly being touched/scratched by using the stylus.
