That's normal, on everyone's 3DS, was on my original 3DS, 3DS XL and on my New 3DS XL, nothing bad butt I wouldn't go nuts by shifting your top screen like that...

my new 3DS XL (zelda edition) slides a tiny bit. you can't even really see it, just feel and hear it. like others have said, it's necessary. yours seems a little too loose though... contact nintendo about fixing it if you're bothered, shouldn't be a big issue in terms of the unit breaking down though.

everyone needs to relax and enjoy the games that are released today and stop worrying what Nintendo will do in a year or two from now.

Again

Spoken with Nintendo EU Helpline and they are made this way.
It's to prevent old issues coming back.

Unless it's more than 1mm then it's perfectly normal.
It's a fault if the screen doesn't have the gap as it has a high risk of strain.

I have checked 7 different units now at a local store and they all had the exact same thing.

Stop worrying and enjoy your new DS

I'm pretty sure this is normal. My Majora's Mask one is doing this too.

My original 3ds xl which I still have doesn't do this but I guess people's 3ds started cracking like the DSl so they changed the design. Glad that it's normal.

I also have this hinge problem. My New 3DS XL wobbles when moved slightly and i've got a gap on one side of the hinges and you can see a metal bar in that space.

I'm here thinking everybody has this problem because I think this is how nintendo made it so that it doesn't crack. They kept it loose so it doesn't crack cause if you think about if they kept it stiff there's more chance of it being snapped and cracked.

It is annoying though but I guess we'll just have to live and deal with it i'm afraid.

This is just my theory

Feel free if you have other opinions!

I just notice that my left side of the top screen has play if i pull upwards and down. Right side is solid

My 3DSXL didn't slide side to side or wobble much, it was quite sturdy, I loved that piece of machine... But my New 3DS Ambassador Edition now slides from left to right / right to left like 1mm and it kinda bugs me, but not going to bother swapping. My screen doesn't wobble like yours though mate... My screen click quite firmly in place - of course I can bend it back and forth a bit but not to your extent like jelly lol.... wobble wobble XD

My New 3DS XL has the same hinge and I don't have any problems with it. I've had the system for almost a year now. My original 3DS never had the same hinge nor did it break either.
