I think I thought of a great idea on how to use the 3D for games!
Here it is:
-The game is played in 2D and 2.5D
-If you play the game in 2D, you might miss hidden passages to other places when the 3D is turned on
-One level could be where there's a giant gap, that you can't get by. That's because you're viewing the plain in 2D! when you turn the 3D on, you'll see a path that goes down.
That would be really challenging Example: "Oh no! How do I solve this puzzle? turns 3D on Well that solves that " I suppose that would be cool, but there isn't much point in a feature like that :/
That's a terrible idea. Everyone (like me) who plays 3DS in 3D get nothing special out of it. Those who prefer to play in 2D have to put it into Migraine Mode at random points. People who can't see the 3D effect (some people just can't), get an unplayable game.

But perhaps some puzzles could also only be solved with 3D off. Otherwise most people would just keep 3D on. Or perhaps a "3D meter" so that you could only have 3D on so much in a level. Also, there could be unique implementation of motion controls. For example, you're in a room with nothing but a chandelier and a locked door. Where's the key? Well, turning the 3D on, you see it was on the wall hidden by the chandelier. To get it down, you have to shake your 3DS, and it drops. Easy enough room, I could see harder ones happening.
Rather than using the slider itself, I think it would be easier to leave 3d on what you want, and have a separate "slider" than controls the game world itself. For example, with the "slider" on all the way, a background platform will be unreachable. But if you pull the slider down, the background will pull in, creating a flat world. The character jumps on, and is carried to the background when you slide it back. 3D is never off unless you set it to be, but when the "slider" is in all the way, the world is 2d, with minimal 3d effect. This way, all players can play the game.

I don't think ESRB/PEGI/etc would rate a game based on a 3D effect...and needing a PIN number only for 3D would kinda stink ...I'm not trying to knock your idea or anything.
By "you have a great idea for a 3DS game", I'd be expecting something more like a fully thought-out concept with an engaging story-line, not a 'peek-a-boo' level feature.
If you mean 'turn on 3d' with the slider bar, then what if their 3D was blocked by parental controls?
Make it a super-bloody game like Assassin's Creed, that way if you have parental controls no way are your parents letting you get it.
