From what I understand, data on the New 3DS isn't overwritten when you transfer from the 3DS - not unless the data exists twice. As such, Majora's Mask 3D should stay on your New 3DS even after the transfer. I can't say for certain exactly how you'd run the transfer, though, so hopefully someone will be able to help with that. (Mainly because I've never transferred to a system with existing data.)
Both accounts will merge once you do the transfer process. It will have deleted the Majora's Mask game on the New 3DS micro SD card, but you can redownload it from the Eshop. Just be sure not to make a NNID on the New system before you start the transfer, and you should be fine.
It's also good to back up your original 3DS' SD card onto a computer, then just transfer that from your PC to the Micro SD card for the New 3DS once the transfer is complete.

the system knows because you use your same nintendo account to log in. so it'll see that you own majora's mask but it isn't on your new system yet. that's my guess.
