Nintendo. They can still transfer even if they won't fix it. Why won't they fix it by the way?
I think if the damage is physical or something and it's not under warranty, they won't bother with it. That's my guess, I take good care of my stuff, so I only had to send systems in repair when something has worn out.
That reminds me...@OP how is the 3DS broken? You didn't really say anything else there...
@Xilef: @Megumi: My brother opened it because the D-Pad was broken and he was trying to fix it himself. And Nintendo won't fix it because someone that isn't THEM opened it. Even if I DID buy a refurbished 3DS from them, they said they can only transfer my game licenses over, and not any actual game data, so I'm hoping that there's some 3DS tech wiz out there who CAN transfer the data.
I believe some data saves to the system itself so there is no way to transfer the data that is tied to the system. Best bet is send it to Nintendo and when you get a new one tell your brother to keep his hands off of it.
