Hmm, this is rather interesting. I wonder if this is what the actual prices of the games will be or just a kind of temporary placeholder until Nintendo officially announces it. This could be accurate considering that there is no disclaimer. I remember when Amazon listed the Kinect's price at $150.00 before Microsoft officially announced the price, it was correct.

Check if they have a price guarantee, so that if the price ends up higher or lower than the preorder price, you pay the lowest price.

Doesn't Amazon usually sell games around 5 dollars cheaper then everyone else? So it's safe to assume that most games will be 39.99? Nintendo obviously is an exception because their prices NEVER change. I mean my god, Twilight Princess is still full price, what happened to Players Choice Nintendo!? Greedy buggers!

I thought Amazon sold games at RRP for pre-orders and around release? It's just that their prices drop a lot more quickly than other retailers.

If that's the standard price for 3DS games and not some random Amazon estimate, I'm thrilled. Even if I don't buy a 3DS until the Lite version, I might just buy some games to amass a decent collection first. Not too worried about Nintendo dropping their prices on me, knowing them and their full-price launch titles that don't drop.
